Frequently Asked Questions

We understand that you may have many questions about the divorce process. Here are some of the most common questions we receive, along with their answers

The process of getting a divorce in India involves several steps. First, a divorce petition is filed by one spouse. The other spouse is then served with the divorce papers and given a chance to respond. The court will then schedule a hearing, during which both spouses can present their case. After considering all the evidence, the court will issue a divorce decree.

The duration of the divorce process in India can vary depending on the complexity of the case and the cooperation of both parties. However, it typically takes about six months to a year from the date of filing the divorce petition to the issuance of the divorce decree.

There are several grounds for divorce in India, including cruelty, adultery, desertion, conversion to another religion, mental disorder, renunciation of the world, and presumption of death. The specific grounds for divorce will depend on the circumstances of your case.

An uncontested divorce is when both parties agree on all issues including division of property, child custody, and support. A contested divorce is when the parties cannot agree and these issues must be decided by the court.

A no-fault divorce is one where the spouse asking for a divorce does not have to prove that the other spouse did something wrong. In India, no-fault grounds for divorce include living apart for a continuous period of one year or more, mutual consent, and incurable insanity.

In India, there is not a set rule for division of property in divorce cases as it depends on the couple’s circumstances. However, generally, the court tries to divide property equitably.

Child custody is determined based on what is in the best interest of the child. The court considers several factors including the child’s age, health, emotional ties with parents and siblings, and the parents’ ability to provide for the child’s needs.

Joint custody means that both parents share legal custody of the child and the child has two homes. In India, joint custody can be granted by the court if it is in the best interest of the child.

Alimony, also known as maintenance, is financial support paid by one spouse to the other after divorce. It is determined by the court and depends on a variety of factors including the length of the marriage, the financial situation of both parties, and the needs of the spouse seeking alimony.

Yes, a divorce decree can be modified if there are significant changes in circumstances. This can include changes in income, relocation, changes in the needs of children, etc.

Mediation is a process where a neutral third party, known as a mediator, helps the divorcing couple negotiate and resolve issues to reach a settlement.

Annulment is a legal procedure for declaring a marriage null and void. Unlike divorce, it is retroactive, meaning that an annulled marriage is considered to be invalid from the beginning as if it had never taken place.

Women have the right to maintenance during and after divorce. They also have the right to child custody, and in case of adultery, they have the right to divorce. If they are unable to support themselves financially, they may be entitled to alimony.
